Interplay Fires Back At Bethesda Over Fallout MMO Licensing (News)

Original Fallout IP owner and current licensee Interplay has filed a counterclaim accusing current Fallout owner Bethesda for breach of contract, claiming that Interplay's own Fallout MMO has a playable demo -- indicating production status -- and that Bethesda tried to grant Fallout MMO rights to sister company ZeniMax Online.

Interplay, which sold the rights of the venerable PC-derived Fallout series to Bethesda in 2007 for $5.75 million, alleged in an October 16 court filing that Bethesda breached the Fallout series asset purchase agreement -- the same allegation that Bethesda put to Interplay.

An Interplay stockholder details the countersuit filed by Interplay against Bethesda in reaction to Bethesda's lawsuit over the rights to Fallout Online and the original Fallout games. Interplay argues Bethesda is in breach of contract abd the contract to sell the rights to the series to Bethesda is null and void and Interplay owns the franchise again.

Gearbox boss Randy Pitchford has said that the studio's upcoming action RPG Borderlands will be "less boring" than Fallout 3, in an interview in the latest issue of OXM.

He was talking about Borderlands' action focus, which he thinks will attract an audience who don't have the patience for Bethesda's opus.

"I understand why we do those games [like Fallout 3] but I don't know - do we want that? I think that game could have been much better if it didn't have a single dialogue tree. Honestly. And if it was more action-orientated, and if the shooting was better."

Gamervision reports: 7-Eleven's gaming experience started with Halo 3, where they staged midnight openings all around the United States and forced gallons of Slurpees into unsuspecting fans' bellies (needed to get those collector's cups!). Since then, they've remained on the scene, breaking occasional street dates thanks to employees who don't give a damn about gaming. Thanks for that copy of Gears of War 2, guys. Following May's Anchorage and The Pitt combo-pack, Bethesda has confirmed with Joystiq that the second Fallout 3 DLC retail pack featuring Broken Steel and Point Lookout will hit store shelves on August 25 for $20 on both Xbox 360 and PC. You'll need Mothership Zeta – the fifth and "final" piece of Fallout 3 DLC – to round out your DLC collection. It's currently available for $10.

If you're late to the Fallout 3 bus, you may want to consider holding off until October when you can pick up the previously announced Fallout 3 Game of the Year Edition which bundles the game with all five DLC packs. It's currently listed for $59.99 for the PS3 and Xbox 360 releases, and $49.99 for PC with an October 13th release date on both Amazon and GameStop.

In an email interview with Jeff Gardiner regarding August 3rd's release of the next "Fallout 3" DLC, "Mothership Zeta," MTV Multiplayer asked if it would even be possible to increase the level cap from its current 30 (as set by "Broken Steel.") Specifically, if the stat caps were boosted beyond 10 and skill caps were boosted beyond 100, would the game system simply break?

Clearly it's not the first time Gardiner has had the question, but his reaction was a bit more focused.

We're excited and eager to bring Fallout 3 DLC to PSN. Unfortunately, the content is going to be releasing later than originally expected. Our DLC expands on the original game tremendously - each DLC offering 4-6 hours of additional content - and is no trivial undertaking. Here's a brief look at the DLC you'll be able to play.

* Operation: Anchorage (pictured above) – Enter a military simulation and fight in one of the greatest battles of the Fallout universe - the liberation of Anchorage, Alaska from its Chinese Communist invaders.
* The Pitt (pictured below) – Journey to the industrial raider town called The Pitt, located in the remains of Pittsburgh and choose sides in the battle between the slaves and the slavers.
* Broken Steel (pictured below) – Join the ranks of the Brotherhood of Steel and rid the Capital Wasteland of the Enclave remnants once and for all. Continues the adventure past the main quest and raises the game's level cap to 30.

Bethseda Promises Update On Fallout 3 DLC For PlayStation 3 'Next Week' (News)

There was much rejoicing when Bethesda Softworks revealed the ongoing, extensive downloadable content support for Fallout 3 would no longer remain exclusive only to Xbox 360 and PC. PlayStation 3 owners have been begging for the add-ons, too, with Bethesda dodging reporters' questions on the subject. In May, when Bethesda announced PlayStation 3 support, they also issued a release date for the first content -- late June.

Obviously, it's not late June anymore. What happened? Nothing showed up on the PlayStation Store this week and Bethesda's been mum on the subject. Fallout 3's downloadable debut on PS3 may have been delayed, but an update is coming.

Bethesda has told Eurogamer that "finishing touches" are being made to Operation: Anchorage on PS3, but offered no firm release date for the Fallout 3 content. We had been prepared for a late June launch.

Speaking exclusively to Eurogamer, chief spokesperson Pete Hines said getting the DLC (which has already been released on PC and Xbox 360) to work on PS3 takes quite a lot of effort, actually.

Bethesda announced today that the previously exclusive downloadable content for the Xbox 360 version of Fallout 3 will be coming to the PlayStation 3. Bethesda has been working on implementing it for a while and are looking forward to bringing it to PS3 gamers via the PlayStation Network. Operation: Anchorage will be released for PS3 in June, followed by the release of The Pitt and Broken Steel 4-6 weeks apart. Release dates will be forthcoming.

In addition, a new update will be released for PS3 that will allow users to download and play the new DLC. The release date for that update will be announced at a later date.

Financial papers from Interplay suggest that Bethesda may intend to sue the struggling publisher over its planned Fallout MMO.

Interplay retained the rights to make online games based on Fallout when it sold the rest of the rights to Bethesda in 2004. However, it seems there were certain conditions involved in this - conditions which Bethesda claims have not been met.

According to the Securities and Exchange Commission filing, Bethesda claims that Interplay is in breach of their agreement because it had not commenced "full scale development" of the Fallout MMO by April 4 2009, and has not secured enough funding for the game.

Indie retailer Awesome Games settles with Bethesda following purchase of potentially stolen goods

Awesome Games has negotiated an out of court settlement with Bethesda, following the accusation that the indie had sold stolen copies of Fallout 3.

The Walthamstow-based independent admitted it had bought Fallout 3 from an unknown seller, believing it to be imported stock. However, the title had not been released, and Bethesda believed the goods to have been stolen.

Nintendo icon Shigeru Miyamoto has been voted by industry and media experts as the recipient of the ELAN's first videogames Lifetime Achievement award this year.

John Yamamoto yesterday revealed that Square Enix have struck a licencing deal with Emergent over the use of its Gamebryo Engine, which was used to power the hugely successful role-playing title Fallout 3. There's little doubt as to the four key titles that look set to dominate proceedings at this year's ELAN Awards, with Left 4 Dead, Fallout 3, Gears of War 2 and Fable II all nominated in the majority of the nine categories.

In with a chance of winning seven awards apiece are Valve's zombie shooter Left 4 Dead and Bethesda's dark future RPG Fallout 3, while Epic's FPS sequel Gears of War 2 and Lionhead's fantasy adventure Fable II are both up for six awards.

In fact, of the nine categories - which each contain four nominations - those exact four will battle it out in four, while other prominent titles to be nominated just once include Crysis: Warhead, Lord of the Rings Online: Mines of Moria, Call of Duty: World at War and Too Human.

The awards, which also present prizes for the animation and visual effects industries, will take place in April and be hosted by the voice of SpongeBob SquarePants, Tom Kenny.

Yeah you saw that right. On the bestselling video game page on Amazon.com (which is updated hourly), for right now at least, Fallout 3 is number one. Make that the Fallout 3…for the Playstation 3! It even toppled the Nintendo Wii products (which Killzone 2 did some time ago).

This is despite Bethesda making the DLC (for now) 360 exclusive and Bethesda having given a middle finger towards the Playstation 3 version when it comes to giving them anything extra besides trophies.

the latest Fallout 3 patch isn't just preparation code for the upcoming DLC… one of the small issues with the launch 360 game has been addressed: the specular maps are back. Perhaps the omission was simply a bug? Or perhaps not, because while the effect has been replaced in the more obvious locations, elsewhere it is still absent. But regardless, it's an obviously welcome addition for 360 owners, and we presume that the upcoming DLC will be looking as good as it can possibly be.

Those of you who prefer to play Fallout 3 on the PC and have yet to download Operation: Anchorage DLC should take note of some reported issues. Forum users at the official Games for Windows site are reporting that the game fails to recognize the DLC in some instances.

According to a GFW forum mod, it takes a couple of minutes to validate the DLC (see: boot up your game, go into the Wastelands, wait), but some users are still having problems accessing the content.

This is while both the 360 version and the PC version of the popular game is scheduled to recieve post-ending content for their versions. Many people, even though that have no plans to buy a PS3 console, have called this move highly unfair and without a reason behind it.
