The only other place to obtain the track was iTunes.

 &lt;br&gt; According to data provided by the band&#039;s management, Tenth Street Entertainment, the track was downloaded more than 47,000 times via the Xbox 360 version of the game alone in the first week after it became available.

 &lt;br&gt; Just hours after it transpired that developer Harmonix had filed and then withdrawn a lawsuit against Activision over alleged unpaid royalties, Reuters reports that guitar firm Gibson has made a move to sue the Guitar Hero publsher for patent enfringement.

 &lt;br&gt; The manufacturer said that Guitar Hero, which was published by Red Octane and developed by Harmonix until Activision acquired the former in 2006, violated a patent over &#039;technology for simulating a musical performance&#039;.
 &lt;br&gt; 
 &lt;br&gt; Gibson made the complaint in a letter sent to the publisher in January - Activision has already fired back, said Reuters, asking the U.S. District Court for Central California to declare Gibson&#039;s patent invalid and bar it from seeking any damages.
 &lt;br&gt;

 &lt;br&gt; - As usual for Activision, the company will not release any new games for the current fiscal quarter that ends on March 31. The next quarter will see the release of the game based on Dreamworks&#039;s CGI movie Kung Fu Panda along with more downloadable content for Guitar Hero III and Call of Duty 4. The company will also release games later in the year based on another Dreamworks CGI movie Madagascar II.
